TERMS OF SERVICE

Plumbing Gasfitting Drainlaying

These Terms and Conditions of Trade apply between Spire Plumbing (the Supplier, “we”, “us” or “our”) and the person or entity engaging us to supply goods or services (the Client, “you” or “your”).

1. Price and Quotations

Where a quotation has been provided, it remains valid for 30 working days unless otherwise stated. Acceptance of a quotation must be confirmed in writing before work commences. We may withdraw or amend a quotation at any time before acceptance.

Quotations are based on the information available and the costs applying at the date of quotation. Changes in supplier pricing, government charges, taxes, freight or other costs outside our reasonable control may be passed on to you where permitted by law.

Quoted work does not include defects, deterioration, non-compliant work, concealed conditions, poor existing workmanship, or other issues that could not reasonably be identified at the time of inspection or quotation. If such an issue is discovered, we will bring it to your attention and obtain approval before carrying out additional remedial work, except where immediate action is reasonably necessary to make the site safe.

Where work is undertaken on a time-and-materials (charge-up) basis, or where a variation to quoted work is required, Spire Plumbing's current labour, travel, vehicle and material charges will apply.

Standard labour rates (Monday to Friday, 7:30am–4:30pm):

Minimum labour charge: 1 hour.

$95.00 + GST per hour for plumbing work.

$125.00 + GST per hour for gasfitting work.

Drainlaying and specialist work will be charged at the rate stated in the quotation or advised before work begins.

Materials, consumables, subcontractors, equipment hire and other job costs are additional unless expressly included in a quotation.

Unless otherwise agreed in writing, labour and travel time may be charged from the time we leave our base or previous job to the time the work is completed, including reasonable travel associated with the job.

After-hours, weekend, public-holiday, call-out and vehicle/travel charges: These will be charged at Spire Plumbing's current applicable rates as advised at the time of booking or set out in the relevant quotation. Any minimum call-out charge will also be advised where applicable.

2. Payment

For residential clients, payment is due on completion unless another payment arrangement is stated on the quotation or invoice or has been agreed in writing. For commercial or business clients, payment is due by the date stated on the invoice.

For larger projects or work extending over time, we may issue deposits, progress claims or staged invoices for work completed, materials supplied or ordered, and costs incurred up to the invoice date. Where a quotation specifies payment stages (including pre-floor, behind-wall or front-of-wall stages), payment is due in accordance with those stages.

If you dispute an invoice or payment claim, you must notify us in writing as soon as reasonably possible and, where applicable, within any timeframe required by the Construction Contracts Act 2002.

Overdue amounts may incur interest at 2.5% per month, calculated daily, together with reasonable debt collection, legal and recovery costs incurred by us, to the extent permitted by law.

3. Disputes

If a dispute arises in relation to work carried out, payment, or any other matter between us, both parties will first attempt to resolve the matter in good faith. Where the Construction Contracts Act 2002 applies, either party may use the adjudication process available under that Act. Nothing in these terms limits any other dispute-resolution or statutory rights available to either party.

4. Ownership of Goods and Materials

To the extent permitted by law, goods and materials supplied by us remain our property until they have been paid for in full. Where applicable, we may register a security interest under the Personal Property Securities Act 1999 in relation to goods supplied. Any right to recover goods will be exercised only in accordance with applicable law and without causing unlawful damage to property.

5. Risk

Once goods or materials have been delivered to your site or premises, you are responsible for taking reasonable care of them. Subject to applicable law, loss or damage caused by theft, misuse, vandalism, weather, other trades or circumstances outside our reasonable control may be charged to you.

6. Site Access and Installation

You must provide safe and reasonable access to the site and suitable facilities required for us to carry out the work. Unless expressly included in our quotation, our work does not include structural alterations, building work, painting, decorating, electrical work, asbestos removal, excavation beyond the stated scope, or reinstatement by other trades.

You must tell us about known hazards, services, site restrictions and health and safety risks that may affect our work. We may suspend work where we reasonably consider the site unsafe or access inadequate.

7. Time to Completion

We will carry out the work within a reasonable time and will use reasonable efforts to meet any agreed target date. Completion dates may be affected by availability of materials, other trades, inspections, consents, weather, unforeseen site conditions and events outside our reasonable control.

If work outside normal working hours is requested or reasonably required to meet a client-requested deadline, additional charges may apply with your approval.

8. Consents, Permits and Inspections

Unless our quotation specifically states that Spire Plumbing will arrange a consent, permit, inspection or other approval, you are responsible for ensuring all required approvals are obtained before work begins. Where agreed, we may arrange approvals or inspections on your behalf and the associated fees and time may be charged to you.

Any inspection, producer statement, certificate or sign-off provided by us relates only to the work within our scope and, where relevant, to the work completed as at the date of inspection.

9. Workmanship, Warranties and Consumer Rights

We will carry out our services with reasonable care and skill and will remedy defective workmanship for which we are responsible when notified within a reasonable period after completion. Manufacturer or supplier warranties apply to products and materials where available and subject to their terms.

We are not responsible for defects caused by client-supplied goods, misuse, lack of maintenance, alterations by others, pre-existing defects, normal wear and tear, or matters outside our reasonable control.

Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including rights that may apply under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Building Act 2004 or other applicable New Zealand legislation.

10. Delays and Events Outside Our Control

We are not responsible for delay, additional time or loss caused by events outside our reasonable control, including severe weather, natural events, supply shortages, manufacturer or freight delays, strikes, accidents, fire, utility interruptions, access restrictions, consent or inspection delays, or delays caused by other contractors.

11. Variations and Additional Work

Any change to the agreed scope may be treated as a variation. Where reasonably practicable, variations will be agreed in writing before the additional work is undertaken. Variations may affect the price and completion date and may be charged on a quoted or time-and-materials basis.

If urgent additional work is reasonably necessary to prevent immediate damage or address a health or safety risk and we cannot reasonably contact you first, we may take reasonable steps to make the situation safe and will notify you as soon as practicable.

12. Plans, Specifications and Information

We are entitled to rely on plans, specifications, measurements, instructions and other information supplied by you, your builder, designer, engineer or other representative unless an error is obvious to us. We are not responsible for loss arising solely from inaccurate or incomplete information supplied by others.

13. Privacy

We may collect, use and store personal information reasonably required to provide our services, prepare quotes and invoices, manage accounts, communicate with you, meet legal and regulatory obligations, and recover amounts owing. We will handle personal information in accordance with the Privacy Act 2020.

14. General

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. A failure or delay by us in enforcing a right does not waive that right. These terms are governed by New Zealand law.
